Simple solutions

It never fails to amaze me as to how so many people can convert simple situations into complicated ones. I am referring to a story by Kim Arnott that appeared in the August issue of REM. It involves real estate agent Sharon Male and her broker’s refusal to allow transfer of her listings to her new broker.

 

All Ms. Male had to do when she joined the real estate firm, was to have inserted in her Independent Contractor Agreement some wording that if and when she decided to leave the company and transfer to another, that all of her listings (upon vendors approval), would be transferred to her new brokerage firm. It was as simple as that. Even in the absence of such an agreement, most if not all real estate firms would consent to such a transfer, and more particularly so if such is explicitly the wish of the vendor at issue. Perhaps there are some underlying reasons as to why her then broker was (and perhaps continues to be) unwilling to do that.
