The Toronto Real Estate Board has filed a motion to have the legal firm Gowling Lafleur Henderson LLP removed as solicitors of record for Realtysellers Real Estate in the Competition Tribunal case between TREB and the Competition Bureau.
TREB says that Gowlings was its general counsel from 2001 to mid-2007 and “during the period of the retainer, TREB disclosed confidential information to Gowlings relavant to subject matters in issue in the application.
“Should Realtysellers be granted leave to intervene, Realtysellers intends to support generally the position of the Commissioner of Competition, a position adverse to TREB. Gowlings is in an actual or perceived conflict of interest,” says TREB’s motion.
It asks that lawyer Mark Nicholson and the firm be prohibited from advising Realtysellers “or any related party or entity (including Lawrence Dale) with respect to any matters arising from or related to the above-noted proceedings.”
